RELEASE OF LIABILITY -- READ BEFORE SIGNING

In consideration of being allowed to participate in any way with SAVON’S ACADEMY STARS dba ROYAL PALM BEACH STARS, its related events and activities, I,    ______________________________________, the undersigned, acknowledge, appreciate, and agree that:

1.   The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,

2.   I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,

3.   I willingly agree to comply with the stated and customary terms and conditions for participation.  If, how- ever, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the Company immediately; and,

4.   I, for myself  and on behalf  of my heirs, assigns,  personal  representatives  and next of kin, HEREBY RELEASE, INDEMNIFY,  AND HOLD HARMLESS  SAVON’S ACADEMY STARS dba ROYAL PALM BEACH STARS their officers,   officials, agents and/or employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable,  owners and lessor’s of premises  used for the activity ("Releasees"),  WITH RESPECT  TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property associated with my presence or participation, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I HAVE READ THIS RELEASE  OF LIABILITY  AND ASSUMPTION  OF RISK AGREEMENT  , FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

WAIVER

Savon’s Academy Stars. Inc. d/b/a Royal Palm Beach Stars and affiliates is an organization which is the participation______________________________________.  As such, we plan to take photos and/or video at your Training and development in our program.  All photos and videos will be of player engaging in typical basketball program activities.   If a minor is clearly visible and recognizable in a photo being considered for display, permission from a parent, guardian or afterschool program must be granted.  Therefore, Savon’s Academy Stars. Inc. d/b/a Royal Palm Beach Stars and affiliates requests your permission as follows:     I hereby grant permission to Savon’s Academy Stars. Inc. d/b/a Royal Palm Beach Stars and affiliates to use participant’s photograph on its website, posters, exhibits or in other printed or electronic publication (video, CD, newsletters, brochures, etc.) without further consideration and I acknowledge Savon’s Academy Stars. Inc. d/b/a Royal Palm Beach Stars and affiliates’ right to crop or treat the photograph at its discretion.  I also acknowledge that Savon’s Academy Stars. Inc. d/b/a Royal Palm Beach Star sand affiliates may choose not to use these photos at this time but may do so at its own discretion at a later date.   I also hereby waive the right to inspect or approve the photographs or electronic matter that may be used in conjunction with them now or in the future, whether intended use is known or unknown to me and I waive any right to royalties or other compensation arising from or related to the use of the photographs.   I also understand that once an image is published or posted on Savon’s Academy Stars. Inc. d/b/a Royal Palm Beach Stars and affiliates website, the image can be downloaded by any computer with access to the Internet.  I understand Savon’s Academy Stars. Inc. d/b/a Royal Palm Beach Stars and affiliates cannot control unauthorized use of these photos and videos.  Therefore, I hereby agree to release and hold harmless the Savon’s Academy Stars. Inc. d/b/a Royal Palm Beach Stars and affiliates staff, volunteers, contractors or aides, on behalf of Savon’s Academy Stars. Inc. d/b/a Royal Palm Beach Star sand affiliates from and against any claims, damages, or liability arising from or related to the use of the photographs or videos, including but not limited to any reuse, distortion, blurring, alteration, optical illusion or use in composite form, either intentionally or otherwise, that may occur or be produced in production of the finished product.   Savon’s Academy Stars. Inc. d/b/a Royal Palm Beach Stars and affiliates reserves the right to discontinue the use of photos without notice.
